– hereinafter the "Operator" –
1. Who Your Contracting Party Is
1. Your contracting party for the use of this Shop is exclusively the Operator named above. You can also reach the Operator's support through the contact details given above.
2. This Shop is provided under the brand and domain OnlyEntertain (onlyentertain.com). OnlyEntertain is a product of POS Entertainment s.r.o., Prague, Czech Republic ("Platform Provider"). The Platform Provider supplies the Operator solely with the technical infrastructure (platform, games, credits system). Neither OnlyEntertain nor the Platform Provider is the operator of this Shop or your contracting party. No contractual or other legal relationship exists between you and the Platform Provider. The Platform Provider does not offer you any games, owes you no services, does not grant you Credits, and is not the point of contact for your enquiries. The presentation of the Shop under the OnlyEntertain domain and design does not affect this. All rights and obligations under these Terms exist exclusively between you and the Operator named above.
3. The contract for use of the Shop is concluded when you register and, in doing so, actively confirm that you accept these Terms, are at least 18 years old, and know who your contracting party is.
2. What This Shop Is -– and What It Is Not
1. This Shop is a free entertainment offering: games in the style of slot and sports-betting simulations, played with virtual credits ("ENT Credits").
2. This is not gambling. You pay nothing, and you cannot win money or anything of material value. There is nothing to buy and nothing to cash out.
3. Participation Is Free
1. Use of the Shop and participation in all games are free of charge. The Operator does not ask you for money or any other consideration -– not even indirectly (no entry fee, no minimum spend, no mandatory purchases, no "donations").
2. You cannot buy Credits -– neither from the Operator nor from third parties. If anyone offers you Credits in exchange for money, that is not permitted; please report it to the Operator.
3. You receive Credits from the Operator at its discretion (e.g. as a promotion or loyalty gesture). You have no entitlement to Credits.
4. Credits Have No Monetary Value
1. Credits are purely in-game currency. They have no monetary value and are not a balance or deposit.
2. Credits cannot be paid out, transferred, sold or exchanged -– neither for money nor for goods or services, neither with the Operator nor with third parties.
3. Winnings in games are additional Credits. These, too, can be used solely to keep playing in this Shop.
4. The Operator may adjust Credit balances, let Credits expire, or change the credits system. Upon account deletion or termination of the contract, Credits expire without compensation.
5. Credits do not give rise to any claims whatsoever against OnlyEntertain or the Platform Provider.
5. Your Account
1. You must be at least 18 years old and confirm this at registration. Minors may not use the Shop; the Operator will suspend accounts of users who are recognisably minors.
2. To register, you only need a username and a password -– no e-mail address. Your username must not infringe third-party rights and must not be misleading or offensive.
3. One account per person and per Shop is permitted. The account and the Credits booked to it apply exclusively to this Shop; use in other Shops, including those of the same Operator, is excluded. Your account is personal and must not be passed on, sold or lent. Keep your password secret.
4. Important: Since the Operator does not store an e-mail address for you, it may not be able to securely restore your account if you lose your password. Contact the Operator's support (clause 1.1); if secure identification is not possible, the only option is a new registration -– Credits from the old account cannot be carried over in that case.
5. You can have your account deleted at any time without notice period. Simply write to the Operator's support (clause 1.1).
6. Fair Play
The following in particular are not permitted: bots, scripts or any other automation; exploiting technical errors; multiple accounts; interfering with the Shop's technology; any commercial use of the Shop or of Credits; and any behaviour that impairs other players or the operation of the Shop.
7. Gameplay and Malfunctions
1. Games are provided and executed through the Platform Provider's technical infrastructure; game results are determined automatically. In sports-betting simulations, settlement is based on the result data used by the system; cancelled, postponed or abandoned events may be voided by the Operator.
2. If a game or simulation is interrupted or impaired by a technical malfunction (in particular loss of connection, system error or incorrect determination of results), the Operator is entitled to void the affected game round and to reset Credit balances to the status before the round began. There is no entitlement to a particular game result or to Credits arising from game rounds affected by malfunction.
3. Obvious errors in odds, paytables or game results do not give rise to any claims by the user; the Operator may reverse Credit awards based on such errors.
8. Chat and User Content
1. The Shop provides a chat function through which the user can communicate with the Operator. The chat is the designated channel for support requests and for matters under clauses 5.4, 5.5 and 10.
2. Via the chat and any other input fields (in particular the username), the user must not submit content that is unlawful, insulting, threatening, discriminatory, harmful to minors or promotional, that infringes third-party rights, contains malicious code, or relates to the purchase, sale or exchange of Credits.
3. The Operator is entitled to remove content that violates these Terms without prior notice and to restrict or suspend the user's access to the chat.
4. The user grants the Operator a non-exclusive, royalty-free right to store and use submitted content for the purposes of communication, support and record-keeping. Storage is subject to the privacy policy (clause 15).
9. Intellectual Property
1. All rights in the platform, the software, the games, the trademarks (in particular "OnlyEntertain") and in the graphics, texts and other content of the Shop are vested in the Platform Provider, the Operator or their respective licensors.
2. For the term of the user contract, the user is granted a non-exclusive, non-transferable licence, revocable at any time, to use the Shop for private entertainment purposes within the scope of these Terms. No further rights are granted.
3. Reproduction, modification, distribution, decompilation or any other exploitation of the platform, the games or parts thereof is prohibited except where permitted by mandatory law. The grant of the licence by the Operator does not create any legal relationship between the user and the Platform Provider.
10. Play Breaks and Self-Exclusion
1. Even a free gaming offering can take up a lot of time. If you need a break, the Operator will set up a play break (temporary suspension of your account) or a self-exclusion (permanent suspension) for you at any time. Write to the Operator's support (clause 1.1); the suspension will be implemented without undue delay.
2. The Operator will not lift an active suspension early, even if you change your mind -– this is intentional.
11. Availability and Changes to the Offering
1. The Shop is a free offering. You have no entitlement to availability, to specific games, or to the continued existence of the Shop. The Operator may change, interrupt or discontinue the offering at any time.
2. The Operator will endeavour to announce planned discontinuation of the Shop in the Shop with reasonable lead time.
12. Suspension and Termination by the Operator
1. The Operator may suspend or delete your account if you breach these Terms -– in particular clauses 3 to 9 -– or if your age or the information you provided is incorrect.
2. Otherwise, the Operator may terminate the contract with 14 days' notice; it will inform you in the Shop. Your Credits expire upon termination of the contract (clause 4.4).
13. Liability
1. The Operator is liable without limitation for intent and gross negligence and for injury to life, body or health.
2. Otherwise, the Operator's liability is excluded to the extent permitted by law. The Shop is a free entertainment offering; please do not rely on its continuous availability or on the continued existence of Credits.
3. OnlyEntertain and the Platform Provider provide no services to you and are not liable to you, to the extent permitted by law. Claims of any kind are to be asserted exclusively against the Operator.
14. Restricted Territories
The Shop may not be used from certain countries and territories; access from there is technically blocked. Circumventing such blocks (e.g. via VPN or proxy) is not permitted. The Operator may suspend accounts that circumvent blocks.
15. Privacy
The Operator is responsible for the processing of your data. Information on which data is processed when you use the Shop can be found in the privacy policy of this Shop.
16. Changes to These Terms
1. The Operator may change these Terms with effect for the future, e.g. in the event of legal changes or new features. Changes will be displayed to you in the Shop at least 14 days before they take effect (at the latest at your next login).
2. If you do not agree, you can have your account deleted at any time (clause 5.5). If you continue to play after the effective date, the new Terms apply.
17. Final Provisions
1. The law of the country in which the Operator has its seat applies (see Operator details above). Mandatory consumer-protection rights of the country in which you habitually reside remain unaffected.
2. Should any provision be invalid, the remaining provisions remain valid.
